3. Data Sharing & Third Parties
In order to provide our digital infrastructure and automation services, we may have to share your personal data with the parties set out below:
- Infrastructure Providers: Companies that provide cloud hosting, AI language models (e.g., OpenAI, Anthropic), voice synthesis (e.g., Vapi.ai), and CRM systems (e.g., GoHighLevel).
- Analytics & Ads: Google Analytics, Meta Pixel, and similar tracking technologies to monitor site performance and advertising effectiveness.
- Legal Requirements: Third parties to whom we may choose to sell, transfer or merge parts of our business or our assets, or if required by law enforcement.

Part II: Terms of Service
6. Scope of Services
Boss Digital Creative provides digital marketing, custom web development (Next.js/React), CRM implementation (GoHighLevel), and AI automation architecture (Voice AI, Webhooks, Make.com integrations). The specific scope of work, deliverables, and timelines will be explicitly defined in a separate Statement of Work (SOW) or Master Services Agreement (MSA) provided upon client onboarding.
7. Client Responsibilities
To ensure the successful deployment of operational systems, the Client agrees to:
- Provide timely access to necessary third-party accounts (Domain registrars, existing CRMs, social media platforms).
- Provide prompt feedback and approvals during the design and architecture phases.
- Ensure that any proprietary materials, data, or customer lists provided to BDC are legally obtained and compliant with applicable data protection laws.
8. Intellectual Property
Upon full and final payment of all invoices related to a specific project, BDC assigns to the Client all rights, title, and interest in the final front-end deliverables (e.g., the website design, the custom funnel assets). However, BDC retains all underlying rights to proprietary code, automation scripts, webhook logic frameworks, and internal AI prompting structures ("Pre-Existing IP") used to generate the final deliverables. BDC grants the Client a non-exclusive, non-transferable license to use such Pre-Existing IP strictly as integrated into the final deliverables.
9. Limitation of Liability
While BDC engineers systems designed to maximize operational leverage and conversion, BDC does not guarantee specific financial results, lead volume, or Google ranking placements. The Client understands that digital markets are volatile. In no event shall BDC be liable for any indirect, incidental, consequential, special, or exemplary damages arising out of or in connection with your access or use of or inability to access or use the services.
Our total liability to you for all damages, losses, and causes of action will not exceed the amount paid by you to BDC in the previous three (3) months for the specific service giving rise to the claim.
